Terms of Service

These terms govern your use of the HearBack WordPress plugin and the HearBack calling service (together, the “Service”), operated during its pilot phase. By pairing a site with HearBack or topping up a wallet, you agree to them. If you use the Service on behalf of a company, you represent that you can bind that company.
1. What the Service does
HearBack places outbound, AI-assisted phone calls to leads who submit forms on your WordPress site with their consent, qualifies them against questions you configure, sends written summaries to email addresses you choose, and — when you connect a calendar — books appointments on your behalf. The Service is provided from the plugin you install plus a hosted backend we operate.
2. Your responsibilities: consent and lawful calling
- You are solely responsible for ensuring that every lead HearBack calls has given valid, informed consent to be contacted by phone, including by an AI or automated assistant, and that your forms present consent wording that satisfies the laws that apply to you — such as the TCPA and state telemarketing rules in the United States, and equivalent laws elsewhere.
- You must not use the Service for cold calling, purchased lead lists, harassment, emergencies, political or charitable robocalling, or any call that would be unlawful even with the safeguards HearBack applies.
- HearBack's built-in safeguards (consent gating, calling-hour limits, opt-out handling, AI self-identification) help you comply but do not constitute legal advice, and do not shift your compliance obligations to us. You agree to indemnify us against claims arising from calls placed at your direction without proper consent.
3. Wallet, pricing, and refunds
- The Service is prepaid. During the pilot, top-ups are made by bank transfer in $100 increments and are credited to your wallet after we verify the transfer.
- Your wallet is debited for number rental (monthly), per-minute call charges, and number purchase, at the rates shown on our pricing section at the time of use. Rates may change with notice; published figures are approximate and expressed in USD.
- Wallet credit is not a deposit and earns no interest. Unused credit is refundable on request when you close your account, minus charges already incurred; credits issued as goodwill or promotions are not refundable.
- If your balance is too low to place a call, leads are held and you are notified — see the privacy policy for how held leads are handled.
4. Pilot status and availability
HearBack is in pilot. We aim for calls to be placed within about a minute of a form submission, but we do not guarantee call placement, connection, timing, transcription accuracy, or booking success. We may impose reasonable limits (such as daily call caps), change features, or suspend the Service for maintenance. We will give reasonable notice before discontinuing the pilot, and refund remaining paid wallet balances if we do.
5. Your data and your leads' data
Our handling of lead data, recordings, and transcripts is described in the privacy policy, which forms part of these terms. You retain all rights to your leads' data; you grant us the license needed to operate the Service on it. You are responsible for reflecting HearBack's processing in your own site's privacy notice.
6. Acceptable use
You may not resell the Service without our written agreement, attempt to bypass wallet accounting, probe or disrupt the backend, use the AI agent to impersonate a human or a third party, or configure it to deceive, defraud, or collect payment card details or other sensitive data on calls.
7. Disclaimers and liability
The Service is provided “as is” without warranties of any kind. AI-generated conversation and summaries can contain errors; review them before relying on them. To the maximum extent permitted by law, our total liability arising out of the Service in any 12-month period is limited to the amounts you paid us in that period, and neither party is liable for indirect or consequential damages. Nothing in these terms limits liability that cannot lawfully be limited.
8. Suspension and termination
You can stop using the Service at any time by deactivating the plugin and requesting account closure. We may suspend or terminate accounts that violate these terms, generate abuse complaints, or create legal risk; where practical we will warn you first. Sections 2, 5, and 7 survive termination.
9. Changes to these terms
We may update these terms during the pilot. Material changes will be announced by email to your account address, and continued use after the effective date constitutes acceptance.
